ACT, 1906, AND ACTS AMENDING
THE SAME.
ORDINANCE No.
52.
PUBLIC BATHS
AND BATHING.
_________
Application of
Ordinance.
1. This Ordinance
shall apply to Municipalitles, the Councils of which have acquired the
powers of section 109 (xvi) of the Act, viz.:-
The construction,
maintenance, and management of public baths; the regulation of bathing,
and the observance of decency in connection therewith; the provision of
life-saving appliances, danger notices, and life-saving attendants, and
the construction, maintenance, and hiring by the Council or other persons
to the public of bathing-houses and bathing-machines, and the regulation
thereof.
PART A.- BEACH
OR RIVER BATHING.
Application of
this Part.
2. The provisions
of this Part shall not apply to personac bathing at places not exposed
to the public view.
Costume.
3. (a) All persons
over 4 years of age bathing in any waters exposed to the public view other
than baths as defined in Part B, shall be clad in a bathing costume covering
the body from the neck to the knee, so as to secure the observance of decency;
and any inspector may require any person contravening this porvision to
at once resume his ordinary dress.
(b) In any case
where an inspector is of opinion that any person's bathing costume is indecent
or inadequate, or that the material thereof is too thin, or is not in a
proper state of repair, or is for any reason unsuitable, he may direct
such person to, resume his ordinary dress.
(c) If any person
fails to resume immediately his ordinary dress when directed so to do by
an inspector, he shall be guilty or an offence against this Ordinance,
and may, with any necessary force, be removed to the dressing enclosure
or shed by the inspector.
Dressing.- ln
Public View.
4. No person shall
dress or undress, or remove or disarrange any part of his bathing costume
in any place open to the public view.
Separation of
the Sexes.
5. (a) No male above
the age of 8 years shall trespass upon any part of the beach or any dressing-shed,
or any enclosure set apart by the Council for the exclusive use or females,
and ...

by public notice exhibited thereon, except for the purpose of rendering
assistance in case of accident.
(b) No female
shal ltrespass (sic, shall trespass) upon any part of the beach,
or any dressing-shed, or any enclosure set apart by the Council for the
exclusive use of males, and so indicated by public notice exhibited thereon,
except for the purpose of rendering assistance in case of accident.
(c) In cases
where provision is made in the dressing accom- modation for the separation
of boys from men and girls from women, children under the age of 16 years
shall not be admitted to the adults' dressing accommodation except in the
case of children under the age of 6 years accompanied by their parents
or other guardians, and adults other than employees of the Council on duty
shall not enter or use any dressing enclosure set apart for children.
Sun-basking.
6. (a) Where a special
sun-basking enclosure is provided on the beach by the Council, and such
enclosuer (sic, enclosure) is approved of by the Minister for Public
Works, such Minister may give written authorisation to the Council to erect
notices on the beach prohibiting sun-basking except within such enclosure.
(b) Where such
notice has been lawfully exhibited by a Council, persons shall not loiter
or lie about the beach clad only in bathing costume, except within such
enclosure.
Use of Dressing
Enclosures or Sheds.
7. (a) A dressing
enclosure or shed shall be used for dressing and undressing only.
No person shall
play games or, with. out reasonable excuse, loiter therein.
(b) No person
shall bring or deposit any filth or rubbish in any such enclosure or shed.
(c) No person
shall damage, disfigure, or write in or upon, any such enclosure or shed.
(d) The Council
may mark off an area adjacent to any dressing enclosure or shed for the
use of females, and may, by notice conspicuously exhibiton thereon, forbid
male persons above the age of 8 years to go upon any such space.
Any such person
disregarding such notice shall be guilty of an offence against this Ordinance.
Behaviour.
8. In or upon any
part of the beach, dressing enclosure, foreshores, or waters used by the
public-
(a) No person
shall behave in an unseemly, improper. riotous, or noisy manner, to the
annoyance of the public.
(b) No person
shall blaspheme, or use profane or obscene language. or behave in an indecent
manner.
Bathing in Dangerous
Places.
9. (a) No person
shall bathe at or in the near vicinity of any place which is indicated
by a "Danger" board or notice as a place where it is dangerous to bathe.

(b) No person
shaJi bathe at or in the near ,icinity of any place after being warned
by an inspector that it iM dangerous for him or her to bathe at such place.
Surf-shooting.
10. Where any inspector
considers that the practice of surf-shooting (i.e., riding on the crest
of the breaking wave), whether with or without a surf-board, is likely
to endanger or inconvenience other bathers, such inspector may order bathers
to refrain from such practice or to remove to a place where such practice
will not cause danger or inconvenience.
Bathers shall
comply with such orders.
Any inspector
may take possession of any surf-board used in contravention of his or another
inspector's orders
and retain it until the bather from whom it was taken resumes his ordinary
dress, or until such inspector considers that surf-boards may again be
used without endangering or inconveniencing the public.
